Vidrines awarded $1.6 million for malicious prosecution

Opelousas resident Hubert Vidrine’s 15-year battle with the feds over false criminal environmental charges and malicious prosecution ended Friday when Vidrine was awarded $1.67 million in damages from the federal government.

Vidrine sued the government in 2007 on behalf of he and his wife, seven years after he was accused by the feds of illegally storing hazardous waste at the Canal Refinery in Church Point, which Vidrine managed at the time.

As noted in The Independent’s July 20 blog, “When the EPA Swat Team comes a knockin’,” the “hazardous waste” the EPA was in search of more than a decade ago was observed the day before when State Police stopped a truck that was delivering materials to Canal. Field tests showed the materials were questionable, which prompted the EPA to send samples to a laboratory for actual testing:

According to the civil lawsuit Vidrine has since filed against the U.S. government, “subsequent lab reports did not show that Tank 402 contained hazardous waste ... For the following three years, no charges were filed against Canal or any employee of Canal based upon the evidence obtained.”

Throughout the entire investigation, EPA Agent Phillips and FBI agent Ekko Barnhill, who were jointly investigating the case, were having a sexual relationship, according to court filings, one that gave Phillips a reason for needing to travel from Dallas to Lafayette as often as he did.

The United States government eventually dismissed the indictment against Vidrine in September 2003, the night before the trial was set to start and seven years after the raid on Canal took place.

In June, Doherty heard almost three weeks of testimony and referenced upwards of 15,000 case-related documents. At the end of July, Phillips was fired from the EPA after 20 years of employment and indicted on federal charges of obstruction of justice and perjury for lying under oath in an effort to conceal his relationship with Barnhill.

“Neighbors and members of their small community were asking them, again and again, about the indictment and the details of the criminal case,” U.S. District Judge Rebecca Doherty says in her ruling. “The Vidrines testified many people in their small community just assumed Mr. Vidrine was a criminal, merely because he had been indicted. Both felt genuine humiliation, discomfort and embarrassment. The Vidrines went from being well respected and well liked community leaders to objects of diversion and curiosity. Hubert Vidrine is an independent, hard-working, scrappy, almost stereotypical Cajun gentleman. Mr. Vidrine was stripped of perhaps his most valuable asset, his good name, and the consequence of that may never be fully ameliorated.”

Doherty points out in her ruling that punitive damages cannot be awarded in civil cases against the government. If punitive damages were allowed, she says, they would have been given in this case.

“Keith Phillips, for his own purposes, set out with intent and reckless and callous disregard for anyone’s rights other than his own, and reckless disregard for the processes and power which had been bestowed him, to effectively destroy another man’s life - conduct which cannot go unaddressed, or unrecognized,” Doherty says in her ruling.

I know Hubert personaly, what a nice fellow, hard working and cares for his family and community and the 1.67 million should be doubled, he employs people from the surrounding areas keeping them off of unemployment and is a hands on man. I can only hope that appolgies are made public so as to right the accusations made by the EPA.......Sincerely A Harman

Our government officials should not be held up as idols they put their pants on one leg at a time as you and I do. In todays government there " ARE NO HEROES.
GREED HAS WON ! IF we stopped the lobbyists and ran them out of the country you may could find a politician who cares a bit about the people, but even then don't bet on it. Politicians come out from office much more richer than when they took office, that should tell you they are all scam artists, lowlife thieves.

I agree Anton Mr V is a very nice man, wouldnt hurt a flea surely would never allow hazardous waste into his community. The community he and ms T love and raised their children and grandchildren in. thats absolutely absurb - I guess this agent underestimated the fight mr V had in him to prove his innocence. Go MR V so happy this is coming to an end

You anti-gov folks realize that Judge Doherty, the person who awarded 1.6 mil to Mr. V is a government employee, right?

You realize that the people who prosecuted the bad EPA agent are government employees?

Finally, I hope you realize that the entity that provided a forum for the civil redress of this wrong is, the government.

There are good and bad people in government just as in any other corporate, religious, or civic institution. Talk radio and Fox are rotting your already small minds.

I was there the day of the epa raid. It was crazy. They came into the refinery with guns in hand. they told us we wouold all go to jail if we did not tell them increminating informatiom about canal and hubert vidrine. They even pointed a gun at one of the lab employee that did not tell them what he wanted to here. They broke pictures and turned over file cabinates, threw files files all over the floor. One fool pulled out the operating program out of the master computer freezing the plant controls. The plant operator had to get a replacement program or the refinery would go into emergancy shutdown. This could have caused fires and even explosions. The agents showed us no respect. They knew nothing about operating a refinery and were doing things that could have caused injury or worst. When Mr.Vidrine saw this he went off on these agents. He told them to get out of the control room and he would control the orderly rotation of employees to be interviewed. I heard several heated arguments betwee mr. v and these agents over several hours of occupation of the refinery. I know that the reason the agents came after mr. v. was because he did not take their shit. He stood up for us. I'm proud of him for not giving up to the epa. they were wrong and he was right. I know i was there.

No, it was a civil suit. Vidrine and his privately hired attorney sued the EPA, not the government. And if it wasn't for the recourse to civil suits, this "bad" EPA agent would not have been held accountable for engineering an inquisition for the sole purpose of an ongoing sexual affair with an FBI agent.

I was approached by Office of Inspector General Special Agents. I too was asked to lie because the agents did not want to hear the truth. The Agents want to hear what they believe they want to hear. To them the truth does not help their caes. They want to hear you say, yes take me to jail Mr. Agent because I am guilty as you claim (even when you are innocent). They get brownie points for arrests.

Special Agents are corrupt. They only look for incriminating evidence, not exculpatory evidence. Their job is to make your life hell and ruin your history with a criminal record or charge on your RAP sheet. I had absolutely no criminal history in my life. Even though the charges were dismissed for lack of probable cause, it still shows up on my criminal record as a dismissal to this day. I lost my security clearance and countless job opportunities because of it. I proved my innocence, but they caused permanent damage to me and my family. I am stuck working minimum wage jobs because of what they did to my life.
